# Meta, Google, TikTok, and LinkedIn now face an Australian news law whether they carry news or not

**[The Next Web](https://daily.dev/sources/tnw)** · 4 min read · 0 upvotes · 0 comments

## Summary

Australia's parliament passed the News Bargaining Incentive, imposing a 2.5% levy on the local advertising revenue of Meta, Google, TikTok, and LinkedIn if they don't strike commercial deals with at least eight Australian news businesses, regardless of whether they carry news at all. Deals with large publishers offset liability at 150% of value, small/medium outlets at 200%, with no single deal covering more than a quarter of a platform's bill. Unoffset funds go to a News Journalism Payments scheme favoring smaller and regional outlets. LinkedIn was added and the rate raised from 2.25% to 2.5% in early August. AI companies are excluded from the scheme despite using journalism content. Meta has argued the levy breaches the Australia-US free trade agreement but hasn't withdrawn from the market. The law replaces the 2021 News Media Bargaining Code, which collapsed after Meta stopped renewing deals in 2024 because it could only be enforced against platforms that carried news.

## Questions this post answers

### What is Australia's News Bargaining Incentive and who does it apply to?

It is a law passed by Australia's parliament imposing a 2.5% levy on the local advertising revenue of platforms with over A$250mn in that revenue, currently Meta, Google, TikTok, and LinkedIn, regardless of whether they carry news content. The levy can be reduced or eliminated by striking commercial deals with at least eight Australian news businesses before the end of a platform's financial reporting period.

### How can platforms offset the Australian news levy through publisher deals?

Deals with large publishers count at 150% of their value against the levy, deals with small and medium outlets count at 200%, and no single deal can offset more than a quarter of a platform's total liability. This clause prevents one large payment to one large publisher from settling the entire obligation, pushing platforms toward broader deal-making.

### Why did Australia's 2021 News Media Bargaining Code fail to keep working?

The 2021 News Media Bargaining Code produced deals worth a reported A$200mn a year but could only be enforced against platforms that carried news content. Meta exploited this weakness by declining to renew its deals in 2024 and simply not carrying news, prompting Australia to design the new levy so it applies whether or not a platform hosts news at all.
