New York Governor Kathy Hochul imposed a moratorium of up to a year on data centers consuming 50 MW or more, making it the first U.S. state to enact such a ban. However, experts and NYISO officials note that data centers are not currently the primary driver of New York's grid stress. The real culprits are electrification of buildings and transportation, aging generation infrastructure (some plants 70 years old), and a net loss of 1.5 GW of generation capacity since 2019. Summer reserve margins are at their lowest since 2017, with only 417 MW of headroom. The moratorium addresses environmental permitting only — not grid interconnection — so the 14 GW queue of pending projects remains active. The ban buys up to a year for the state to develop a regulatory framework, but experts warn that timeframe may be insufficient to solve the underlying structural grid problems.
