# OpenAI pays $3.2m to settle a US claim it favoured visa workers over Americans

## Summary

OpenAI has agreed to pay $3.2 million to settle a US Justice Department claim that it discriminated against American workers during the Permanent Labor Certification (PERM) process. The DOJ's Civil Rights Division found that OpenAI and its subsidiary Statsig violated the Immigration and Nationality Act by not posting PERM roles on its public careers site, requiring paper mail applications for those roles, and advertising some positions on late-night radio — practices that effectively discouraged American applicants while favoring temporary visa holders. Of the settlement, $1.2m goes to civil penalties and $2m to a compensation fund for affected workers. OpenAI also agreed to reform its recruitment practices, retrain staff, and submit to DOJ monitoring. This is the DOJ's thirteenth such settlement since relaunching its Protecting U.S. Workers Initiative in 2025.
